TERMS AND CONDITIONS
The terms and conditions contained herein (these “Terms and Conditions”) are the only terms which govern the sale of the materials (“Materials”) as specified in the accompanying Invoice (the “Invoice”) and the installation (the “Installation”) of such Materials as provided in the Invoice. The Invoice and these Terms and Conditions (collectively, this “Agreement”) comprise the entire agreement between the parties, and supersede all prior or contemporaneous understandings, agreements, negotiations, representations and warranties, and communications, both written and oral. You acknowledge and agree that your acceptance of the Invoice constitutes your understanding and agreement of these Terms and Conditions.

Warranty:
All merchandise carries the manufacturer’s warranty. Products sold as “Specials” and “Promotional Items” carry no warranty from the respected manufacturer. After Five Floors guarantees a lifetime craftsmanship warranty. After Five Floors make no other warranty of any kind with respect to the materials and installation, whether expressed or implied, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose. Transition pieces are not included in any warranty. All warranties are only valid for original purchaser and are therefore non transferable. Please be mindful that many manufacturer’s as well as your craftsmanship warranties will be void if you are wet/steam mopping your floors, have a rolling office chair or chairs without protective pads, water is present in any form including moisture in the subfloor, room is not temperature controlled, or if floor prep application is refused. These are some of the most common reasons for product failure, but are not limited to these reasons. 

Material Returns:
Orders of less than four (4) cartons may not be canceled or returned. Orders of five (5) or more unopened, resalable cartons may be canceled or returned to After Five Floors within 15 days, some restrictions apply. Returns or cancellations cannot be accepted after 15 days. Trim pieces and accessories also cannot be returned. Special order merchandise also cannot be returned. A thirty-five percent (35%) restocking fee on all canceled and/or returned merchandise will be applied to your account. Shipping and handling fees may also be assessed. Please allow seven to ten (7-10) business days for refund checks to be issued for canceled orders.

Natural Products:
Customers who purchase natural products should expect variations from the sample originally shown at the time of the estimate. No refund or replacement will be made for natural products that have normal color, texture, and appearance variations without an additional charge and/or restocking fee. It is also important to note that pre-existing natural hardwood floors may reveal deep pre-existing stains once sanded. If stains have soaked through the wood entirely, it is impossible to remove these stains with sanding alone. They can be covered using a darker stain color. The only way to remove these stains is replace the affected boards; given the age of the wood, this may not be possible. Please also note that new natural hardwood may not match the stain, color, or gradient of pre-exisiting natural hardwoods. 

Unclaimed Inventory: 
Merchandise that is stored up to or more than three hundred sixty-five (365) days is subject to being sold without compensation to the customer.

Scheduling and Cancellations:
A 50% deposit and signed copy of these terms and conditions MUST be received before scheduling or ordering (if not stocking material) can take place. We cannot give any estimated installation dates before a deposit and signed terms and conditions are received. Please see the last page of this document for directions on making a deposit payment.
If a customer wishes to cancel an installation for any reason after it has already been scheduled, it must be cancelled before 12pm EST on the previous business day. If notice is given after 12pm EST on the day prior to installation, a trip charge fee will be assessed. 
If the customer is not prepared for installation OR excuses, delays, or otherwise kicks the installer off the jobsite before he or she has completed the installation (and is NOT already scheduled to return to the jobsite the next day), the job will be sent to the back of the scheduling agenda and a trip charge will be assessed. The customer will need to reschedule the completion of the job for a later time. We will not be able to return to the jobsite at the customer’s will, as we have other jobs that have already been scheduled.
Installers reserve the right to excuse themselves from the jobsite for any reason that might make them uncomfortable, threatened, or at risk in any way. Trip charges or additional fees may be assessed as a result. 

After Five Floors reserves the right to refuse service at any time. 

Repairs & Limitation of Liability:
After Five Floors is not responsible for existing defects, dry rot, leaks, code violation, or structural repairs. Neither is After Five Floors responsible for damage caused by moisture (including humidity) nor structural flaws. If our installers discover water anywhere in the home, we MUST stop work immediately and the issue must be resolved at the customer’s expense. We will not continue with installation if water is found. Water issues will cause both manufacturer’s and installation warranties to be void.
Subfloor repair, floor prep, and labor is not included in installation services unless itemized on the quote. In the event the subfloor is in need of repair, the installer will stop work and reassess how much floor prep is needed or whether or not the subfloor needs to be replaced. We will try our best to notify you of any changes in floor prep needed, but please note that the quantity of floor prep needed is subject to change as the job goes on. 
Please note that screwing in subfloor and floor joists to eliminate squeaking is not included unless specifically itemized on your invoice. It is also important to know that screwing in subfloor and floor joists is not guaranteed to eliminate squeaks. 
The cost of repair must be paid upon completion. If a job is delayed due to a repair or any other reason, After Five Floors does not compensate for lost time, wages, psychological distress, or alternate lodging or accommodations. 

Plumbing, Electrical, Painting & Carpentry:
No repairing, plastering, carpentry (including the installation of any wood base or molding), decorating or redecorating is included unless specifically charged for and specified. This includes repairs to squeaky subfloors or floor joists. After Five Floors is not responsible for installing or repairing any cabinetry or cabinet accessories of any kind. 
After Five Floors is not responsible for painting or caulking of any kind unless otherwise specified in your invoice. This includes shoe mold, baseboards, stair risers, railing, or touch up. If you are doing sand and finish or any other installation type that involves stain, it is recommended that you hire a painter to come and touch up any stain drippings, marks, and smudges. Our installers are always careful but it is extremely likely that drops, marks, or smudges of stain will get on the walls, stairs, risers, skirts, or railing. 
After Five Floors is not responsible for removing toilets or plumbing fixtures of any kind. Toilets can either be moved by the customer, moved by After Five Floors for $150, or moved by a contracted plumber for $650. If After Five Floors moves the toilet, we are not responsible for any damages incurred or any complications due to rust, rot, leaks, or water damage.
Depending on the type of floor being installed, sometimes the height of the floor can change. After Five Floors is not responsible for any repairs resulting from the changed height of the floor. This includes cutting of doors and door jams. We also cannot help if appliances sit lower or higher due to the change in height. 
After Five Floors is not responsible for any damages that occur from disconnecting or reconnecting any gas or electrical appliances including anything that is hardwired. This includes ice makers or anything connected to a water line. 
Any latent defects discovered during installation shall be corrected at customer’s expense. After Five Floors is also not responsible for popped nails that occur before, during, or after installation. 

Acclimation:
Electrical power must be available at the job site. Temperature at the job site must be kept at normal living conditions for the entire duration of acclimation and the life of the floor. We drop off our materials to be acclimated in your home 24 hours prior to the installation. Failure to allow proper acclimation could result in a void of your warranty.

Trash and Disposal:
Trash and disposal of demolition debris and old flooring materials are only to be hauled away if Disposal Fee is included in your invoice.

Demo and Moving Content:
If you have chosen to move your own furniture, those items MUST be moved by the time we arrive. If our installers have to move any furniture at all, you will be charged an additional fee. This is non-negotiable, as you had the opportunity to add on the furniture removal service at the time of purchase.
Likewise, if you have chosen to demo your own pre-existing floors, demo MUST be complete upon our arrival. Failure to do so will result in an additional charge. This is non-negotiable, as you had the opportunity to add on the demo service at the time of purchase.
After Five Floors’ installers reserve the right to refuse to pull up urine, vomit, or feces soaked floors. If the installer agrees to demo or otherwise touch floors coated in excessive filth of any kind, additional fees may be assessed. Additionally, any biohazard materials found (other than those previously stated) on the premises will constitute an immediate vacation of the premises. If found, a biohazard cleanup company will need to be hired at the expense of the customer. 
After Five Floors’ installers, staff, personnel, and all other individuals in the company will not under any circumstances move, touch, or otherwise handle any item in any property where illicit substances or drug paraphernalia are found. This will constitute an immediate vacation of the premises. 
After Five Floors will not move electronics of any kind (including televisions). After Five Floors is not responsible for damaged furniture nor items that should have been moved out of the way prior to installation. This includes mounted electronics such as televisions and chair lifts. Remember that this is a construction site – please move anything you do not want to get broken. 
After Five Floors will not move small, personal items of any kind (including but not limited to knick knacks, jewelry, articles of clothing, serveware, urns, boxes, lamps, firearms, weapons, fans, hampers/baskets, safes, sheets, pillows, bedding, shoes, or any other item that might sit atop furniture OR on the floor). If our installers must move any small items (NOT large pieces of furniture that is charged separately on the invoice) in order to complete the installation, additional fees may be assessed. Our installers have the right to refuse to move, handle, or otherwise touch personal items. 
Additionally, pets must be secured in a separate room for the entirety of installation. If our installers are forced to leave the property due to unsecured pets, a trip charge will be assessed on your account for the installers’ time and gas. 


If our service does not meet or exceed industry standards, we want the opportunity to make it right. It is our commitment to our customers to offer excellent service and honor all of our warranties and guarantees.

By signing this document, you agree to these terms and conditions and agree to pay the invoice balance upon completion of the job as well as any applicable processing fees or surcharges discussed above.

Terms are due upon receipt. Invoices unpaid 15 days are subject to a charge of 18% APR.

A 3% processing fee will apply to all credit card payment. All transaction fees are non-refundable.
